BY LAWS:
The Legal Department has responsibility for reviewing and approving the by-laws of existing and newly formed local councils and assemblies. In 2008, the Legal Department created an online by-law template for all councils and assemblies to use. All councils and assemblies must use this standard template. Since 2008, the Legal Department has not accepted or reviewed any council or assembly bylaws that have not been prepared using the standard template. The bylaws online program enables councils and assemblies to create a new set of by-laws according to the standard template, receive automatic approval once the template is submitted correctly, and also maintains a historic file of by-laws that have been previously adopted and approved through the program.
If a council or assembly would like to add something to its by-laws that is not included in the template, the best practice is for a council or assembly to adopt a rule by passing a motion or resolution. The rule will not be part of the council or assembly’s by-laws but will be binding upon the council or assembly until amended or revoked. The rule (along with the resolution or motion) does not need to be approved by the Legal Department but should be retained in the council or assembly’s own file as part of its records. Rules adopted by resolution or motion must be consistent with the Laws of the Order.
